Official Giveaway Rules



June 1, 2010 - December 31, 2010

NO PURCHASE NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED.

  1. Acknowledgement. By registering a Demo Account to participate in HuRLO mock trading on www.HuRLO.com (the "Site") you ("you" or "Participant") you are automatically entered to win one (1) of three (3) One Thousand Dollar ($1,000) Giveaways (collectively referred to as the "Giveaways") and acknowledge that you have read these official rules (the "Rules"), understand them and agree to be bound by all of the terms and conditions and any amendments thereto. You further agree to waive any right to claim any ambiguity or error in the Rules, or the Giveaways.

  2. Eligibility Restrictions. To win, you must be a legal United States resident physically residing within the 50 United States or the District of Columbia (residents of Puerto Rico, Guam, the United States Virgin Islands and any other territory or possession are not eligible to win). To win, you must also be at least 18 years old or the age of majority in your state of residence, if such age of majority is greater than 18, as of May 31, 2010. Weather Risk Solutions, LLC ("WRS") and its members, employees, officers, directors, agents and contractors, as well as members of their immediate families and households (including children, spouses, siblings and persons living in the same households as such persons, whether related or not) are not eligible to win.

    The Giveaways are void wherever prohibited, and subject to all federal, state and local laws.

  3. How to Enter. Entry is an online-only process. By registering a Demo Account to participate in HuRLO mock trading on the Site you are automatically entered for the Giveaways. Only one entry is permitted per person; registering multiple HuRLO Demo Accounts will not increase your chances of winning. No entry fee is required. Participants may register beginning on June 1, 2010 at 9:00 a.m. ET until November 30, 2010 at 9:00 a.m. ET. In no event may any Participant be eligible to win more than one (1) Prize (defined below).

    The following information is required for registration: first name, last name, valid email address, zip code of legal residence, telephone number (optional) and age.

  4. Prizes. Three (3) winners will receive One Thousand Dollars ($1,000) each, payable in one lump sum (the "Prize"). In order for a winner to accept the Prize, the winner is required to provide proof of age and residence and agree to be interviewed by WRS (see #5 below for further details). The Prize winners are responsible for the payment of all taxes attributable to the Prize, as applicable. All other expenses and incidentals not specified herein are the sole responsibility of the winners. No substitution or transfer will be permitted. WRS reserves the right to postpone, amend or modify the Giveaways and these Rules for any reason, in the sole discretion of WRS.

  5. Winner Selection & Notification. Three (3) winners will be selected randomly between June 15, 2010 and November 30, 2010 in three (3) different drawings, as follows: One (1) drawing will be held if and when the number of registered Participants equals 2,000; one (1) drawing will be held if and when the number of registered Participants equals 3,000; and one (1) drawing will be held after November 30, 2010, regardless of the number of Participants registered.

    The odds of winning are dependent upon the number of entries received as of each drawing. Winners will be notified via email and telephone. Winners must sign and return within ten (10) days of notification: (i) an IRS Form W-9 (or the equivalent), and (ii) an affidavit of eligibility and publicity release. If a potential winner cannot be contacted or fails to sign and return the affidavit and release within the required time, or if a Prize or Prize notification is returned as undeliverable, the potential winner forfeits the Prize and an alternate will be selected.

  6. Ownership of Content. The Site (and its content) (collectively the "Content"), is protected by copyright and trademark laws and international copyright treaties, as well as other intellectual property laws and treaties. WRS retains all rights, title and interest, including, without limitation, ownership of all intellectual property rights relating to the Content or otherwise residing within the Site.

  7. Participant Behavior. WRS reserves the right to exclude from eligibility any Participant who acts (or is suspected of acting) irresponsibly or inappropriately in participating in HuRLO Demo Account mock trading or entry for the Giveaways. All such action will be determined by WRS in its sole discretion. Participants who register more than one (1) Demo Account may be excluded from eligibility to win a Prize.

  8. Demo Account Notice. HuRL0™ is a commodity option but it is not yet available for exchange trading. A Demo Account offers a simulated trading experience. Demo Account trading does not take place on a real exchange and does not involve the use of real money. Each Demo Account will display a simulated Authorized Purchase Limit. All orders placed, trades executed, settlements and balances displayed are for demonstration purposes only. Fees are applied for demonstration purposes only. You will not really be charged any fees for participating. Demo Account trading performance is not indicative of future trading performance on an exchange. The liquidity represented in the simulated trading environment may differ from the liquidity on an exchange.

  9. Governing Law. These Rules shall be governed by, and construed in accordance with, the laws of the State of New York, without regard to conflict of laws provisions. Sole and exclusive jurisdiction for any action or proceeding arising out of or related to these Rules shall be an appropriate state or federal court located in the State of New York, and your use of and access to this Site acts as an express consent to the jurisdiction of such appropriate state or federal court located in the State of New York.

  10. Disclaimer. Winners assume all liability for any injury or damages caused or claimed to be caused by his or her participation in the mock trading, the Giveaways, the acceptance, use of any Prize, and release WRS and its members, employees, officers, directors, agents and contractors (collectively "Released Parties"), from any liability. Released Parties assume(s) no responsibility for any injury or damage to Participant's or to any other person's computer relating to or resulting from mock trading or the Giveaways. Entry constitutes permission (except where prohibited by law) to use winners' names, city, state, likeness and/or voice for purposes of advertising, promotion and publicity without additional compensation. Any attempt by a Participant or any other individual to deliberately damage any online service or the Site or undermine the legitimate operation of the mock trading or Giveaways is a violation of criminal and civil laws and should such an attempt be made, WRS reserves the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law.
